Mark Weinstein goes Comparative

Mark Weinstein, Professor of Law and Associate Dean at California Western School of Law traveled to Chile in late July to participate in the joint post-graduate program at the University of Chile.

The 24 students – law professors, government and private lawyers – got a real lesson in comparative law.

In the last week of July 2005, Professor. Dr. Burkhard Hess of the University of Heidelberg spoke about reforms in the civil law of Germany to the students.  Profesora Paulina Veloso of the University of Chile Law School’s Civil Law Department, also spoke about Chilean efforts in the civil law arena, particularly in context of recent changes in the country’s family law.

On the 25th of July, Professor Weinstein lectured for three hours on U.S. civil procedure and the importance of jury trials.  For Professor Weinstein, “this has been an incredible experience professionally and personally.”

The program continued with a surprise roundtable discussion on July 27 with Professor Weinstein, a U.S. trained lawyer, and his Chilean and German colleagues, all of whom were provided with three hypothetical cases about family law.  Explains Weinstein, “we had to compare the way situations would be treated in Germany, in Chile under the new divorce law, and in the U.S.  I think the students enjoyed the way that they could directly compare how the same situation could be treated by three different systems designed to accomplish each countries goals.”

With wife Barbara, Professor Weinstein visited Valparaiso and Viña del Mar on a day off from teaching:  “The coast was an amazing experience and the contrast between the two cities was so interesting.  We went to the Pablo Neruda house and museum.  Valparaiso is truly one of the most unique cities I have ever visited...between the inclines and the houses on all of the hills, it must be directly experienced to be understood.”
